The principal was one of the key witnesses, in connection with which the opponents attempted to exert pressure on the principal in order to persuade him to give the “necessary” testimony, unknown people posted the principal’s personal data on social networks, threatened and insulted his address. In this situation, there was a real threat to the client’s safety during interrogation in court as a witness in a criminal case, in connection with which lawyer Andrey Bochkarev, in agreement with the client, took measures to ensure his safety. Forwarding appeals to the chairman of the court, as well as to the prosecutor participating in the criminal case on the side of the prosecution, about ensuring security during the court session, prompted the officials in accordance with the provisions of the Federal Law “On State Protection of Victims, Witnesses and Other Participants in Criminal Proceedings” No. 119-FZ from 20.08.2004 to issue a resolution on the application of security measures in relation to the witness. Subsequently, law enforcement officers provided personal protection for the client, including when going to court, participating in a court session and returning home. The presence of police officers providing personal protection for the principal had a sobering effect on opponents. Before participating in the court session and during its holding, any possible attempts of physical or psychological influence on the principal were excluded, which made it possible to interrogate the principal in the court session in a calm atmosphere, to exclude provocations and aggression in relation to the principal.
Thus, the Rezolut employees have proven in practice that at present the application of state protection measures in relation to a witness in a criminal case is a real and effective tool to prevent unlawful actions against a witness and ensure his safety in connection with participation in criminal proceedings.
