Having identified a number of violations of fire-prevention legislation in the shopping center, the Directorate of the Main Directorate of the Ministry of Emergency Situations of Russia in the Sverdlovsk region issued instructions, initiated the initiation of several cases of administrative offense. Not limited to this, the Ministry of Emergency Situations also applied to the court with a statement to suspend the operation of the entire building of the shopping center, justifying its claims allegedly by protecting the rights of consumers.
Verkh – Isetskiy District Court of Yekaterinburg granted the motion of the senior lawyer of Rezolut Radmila Isakidis to terminate the proceedings, agreeing with her arguments about the supervisory authority’s attempt to replace the security measures in the case of an administrative offense with claims, for which the EMERCOM units have no authority. Thus, the court stated that the Ministry of Emergency Situations did not have the right to bring a claim in defense of an indefinite circle of persons to suspend the operation of the shopping center building.
