The Client turned to the law firm Rezolut with a request to protect his interests in a dispute with a counterparty regarding the payment of a fee for connecting a capital construction facility to centralized cold water supply and sewerage systems. The dispute was complicated by the debtor’s refusal to pay the debt for more than 2 years and the Client’s lack of the original contract and other primary reporting documents. Andrey Bochkarev, having carried out serious pre-trial work and collected the necessary evidence, applied for the protection of the Client to the Arbitration Court of the Sverdlovsk Region.
In the trial, despite the Respondent’s statements that there were no grounds for collecting funds, the lawyers presented a set of evidence confirming the performance of the work and their cost. Based on the results of the court proceedings by the Arbitration Court of the Sverdlovsk Region, the Client’s claims were satisfied in full, the principal debt was recovered in the amount of 3 million 546 thousand rubles and a penalty in the amount of 1 million 762 thousand rubles.
The judgment was reviewed by the 17th Arbitration Court of Appeal and upheld.
